1. Scope
These General Terms and Conditions of Sale ("T&Cs") govern the entire contractual relationship between, on the one hand, the company TRANSPORTS TMD, a French SAS with share capital of €15,000, registered with the Salon-de-Provence Trade and Companies Register under number 819 965 674, whose registered office is at La Feuillane - Lot 78 - ZA de la Feuillane, 13270 Fos-sur-Mer (France), operating the website atlantiqbox.com under the trade name «Atlantiq Box» (hereinafter the "Seller" or "Atlantiq Box") and, on the other hand, any natural person not acting as a trader (hereinafter the "Customer" or "Consumer") making a purchase via the website atlantiqbox.com.
They apply to any Customer residing in a Member State of the European Union, the United Kingdom or Switzerland. For other countries, a specific quotation is issued.
These T&Cs comply with Directive 2011/83/EU on consumer rights, the French Consumer Code (in particular articles L111-1 to L121-23 and L221-1 to L221-29), and equivalent provisions of other applicable national consumer laws.
2. Pre-contractual information
In accordance with article L221-5 of the French Consumer Code, the following information is made available to the Customer in a clear and intelligible manner before the contract is concluded:
- the essential characteristics of the goods or services;
- the total price including all taxes;
- delivery costs, where applicable;
- payment, delivery and performance arrangements;
- the date by which the Seller undertakes to deliver the goods;
- the conditions for exercising the right of withdrawal and the model form;
- the existence of legal and commercial warranties;
- the duration of the contract and the conditions for its termination;
- the existence and arrangements for implementing consumer mediation.
3. Acceptance of the T&Cs
Acceptance of these T&Cs is evidenced by ticking the box "I accept the general terms and conditions of sale" when finalising the order or electronically signing the quotation. This acceptance is a prerequisite for placing any order and constitutes informed consent by the Customer.
The Seller reserves the right to amend these T&Cs at any time. The applicable T&Cs are those in force on the date of the order.
4. Products
Atlantiq Box markets four product families:
- Standard shipping containers (dry 20', 40', 40' HC, 45' HC) — new "One Trip" or used (Cargo Worthy CW, Wind & Water Tight WWT);
- Special containers (refrigerated reefer, flat rack, open top, tank);
- Modified and fitted containers (office, sanitary, workshop, housing);
- Bungalows and mobile homes compliant with EN 1647;
- Accessories and spare parts (locks, seals, floors, corner castings, etc.).
Detailed technical specifications appear on each product page and are confirmed in the quotation. Photographs and plans are indicative; only plans approved with the quotation are binding.
5. Order and quotation
5.1 Mandatory personalised quotation
Standard shipping containers, special containers, modified containers, bungalows and mobile homes are subject to a mandatory personalised quotation. The Customer submits a request via the online form or by phone. A dedicated sales contact issues a firm quotation within 24 business hours, valid for 14 calendar days unless otherwise stated.
The quotation precisely indicates the product, configuration, dispatch depot, transport costs, applicable VAT and the estimated delivery time.
5.2 Direct purchase of accessories
Accessories and spare parts may be ordered directly online with immediate payment, without a prior quotation.
5.3 Order confirmation
Every order is confirmed by an email acknowledgement summarising the essential elements (product references, prices, lead times, delivery conditions). The contract is formed upon receipt of this acknowledgement.
6. Prices
6.1 Currencies
Prices are displayed in euros (EUR), pounds sterling (GBP) or Swiss francs (CHF) depending on the Customer’s preference. The billing currency is locked at order confirmation, at the ECB rate of the day.
6.2 Value Added Tax (VAT)
Prices displayed to consumers are inclusive of all taxes. The VAT rate applied depends on the country of delivery in accordance with the European OSS (One-Stop-Shop) regime:
- France: 20% (CGI art. 278);
- Belgium, Netherlands, Spain: 21%;
- Germany: 19%;
- Italy: 22%;
- United Kingdom: 20% UK VAT above the £135 threshold;
- Switzerland: 8.1% (current standard rate).
The actual VAT applied appears on the quotation and the final invoice.
6.3 Price changes
Displayed prices may be amended at any time; applicable prices are those in force on the date of the order. For orders subject to a quotation, the price is guaranteed for the duration of the quotation’s validity.
7. Payment terms
7.1 Accepted payment methods
Three payment methods are accepted:
- Credit card via Stripe (Visa, Mastercard, AmEx, Apple Pay, Google Pay) with systematic 3D Secure 2 authentication;
- Bank transfer with manual confirmation via a secured signed link sent by email.
7.2 Payment security
Card payments are processed exclusively by Stripe Inc., certified PCI-DSS Level 1. Atlantiq Box does not store or directly process its Customers' bank card data.
7.3 Payment schedule
Unless otherwise agreed in the quotation, payment is due in full at order time for accessories (direct purchase), and according to a 30% deposit / 70% before dispatch schedule for containers, bungalows and mobile homes.
8. Delivery
8.1 Service area
Atlantiq Box delivers throughout the European Union, the United Kingdom and Switzerland. For other destinations (Norway, Balkans, Maghreb, West Africa), a specific logistics quotation is issued.
8.2 Incoterms 2020
The applicable Incoterms are:
- EXW (Ex Works): collection by the Customer at the dispatch depot. No transport or customs costs included;
- DAP (Delivered At Place): delivery to the Customer’s address. Outside the EU, import duties and destination VAT remain payable by the Customer;
- DDP (Delivered Duty Paid): delivery all-inclusive, customs duties and destination VAT paid by the Seller.
8.3 Delivery times
Lead times are indicative and run from confirmation of payment (or deposit):
- Accessories in stock: 2 to 5 business days;
- Containers in depot stock: 5 to 10 business days;
- Bungalows and mobile homes in stock: 10 to 20 business days;
- Bespoke modified containers: 4 to 12 weeks depending on technical complexity;
- Special containers on order: 8 to 16 weeks.
In accordance with article L216-2 of the French Consumer Code, in the absence of an agreed delivery date, the Seller delivers the goods without undue delay and at the latest 30 days after the conclusion of the contract. In the event of delay, the Customer may, after having put the Seller on notice to perform within an additional reasonable time which has expired without performance, terminate the contract by registered letter or email.
8.4 Receipt and conformity
The Customer must check the condition of the goods on delivery in the presence of the carrier and, where applicable, raise specific and reasoned reservations on the delivery note. Any apparent damage must be reported to Atlantiq Box within 3 business days of delivery.
8.5 Transfer of risk
In accordance with article L216-4 of the French Consumer Code, the risk of loss or deterioration of the goods is transferred to the Customer at the moment when the latter (or a third party designated by the Customer, other than the carrier) physically takes possession of the goods.
9. Right of withdrawal
9.1 Period and exercise
In accordance with articles L221-18 to L221-28 of the French Consumer Code and Directive 2011/83/EU, the Consumer has a fourteen (14) calendar day period from receipt of the goods to exercise the right of withdrawal, without having to give reasons or bear any cost other than that of return.
To exercise this right, the Consumer notifies the decision by an unambiguous statement, either by using the model withdrawal form attached to the order confirmation, or by post or email to contact@atlantiqbox.com.
9.2 Effects of withdrawal
In the event of withdrawal, the Seller refunds all sums paid (including standard delivery costs) at the latest within 14 days of receipt of the withdrawal decision, by the same payment method as that used for the order, unless the Customer expressly agrees to another method.
The Customer returns the goods without undue delay and at the latest within 14 days of communicating the withdrawal decision. The direct return costs are borne by the Customer, unless the Seller has agreed to bear them or the returned goods are a container, bungalow or mobile home, in which case the return cost may be substantial and is the subject of a specific quotation.
9.3 Exclusions from the right of withdrawal
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:
- goods made to the Consumer’s specifications or clearly personalised (bespoke modified containers, bungalows and mobile homes);
- goods unsealed by the Consumer after delivery and which cannot be returned for hygiene reasons (seals, certain spare parts);
- the supply of services fully performed before the end of the withdrawal period and the performance of which began with the prior express agreement of the Consumer;
- used goods identified as such in the quotation (a CW container is a used product).
10. Warranties
10.1 Legal conformity warranty
Atlantiq Box is bound by the legal conformity warranty provided for in articles L217-3 et seq. of the French Consumer Code. This warranty covers conformity defects existing at delivery and appearing within 2 years of delivery.
The Consumer may, at their choice, request the repair or replacement of the goods, subject to the cost conditions provided for in article L217-12. Failing this, the Consumer may obtain a price reduction or termination of the sale.
10.2 Hidden defects warranty
In accordance with article 1641 of the French Civil Code, the Seller is required to warrant the Customer against hidden defects rendering the goods unfit for their intended use. The Customer must act within 2 years of discovering the defect (Civil Code art. 1648).
10.3 Commercial warranty
Beyond the legal warranties, Atlantiq Box may grant a specific commercial warranty depending on the product family. Details (duration, scope, exclusions) appear on the product page and are confirmed in the quotation. See also our Warranty page.
11. Liability
Atlantiq Box’s liability can only be engaged in the event of proven fault on its part. It is, in any event, capped at the amount of the disputed order, save in case of gross negligence, wilful misconduct or personal injury and except where the law excludes such limitation.
Atlantiq Box cannot be held liable for indirect damages, in particular loss of profit, loss of business, damage to reputation or consequential intangible damages.
The Seller is exempt from any liability in case of force majeure (article 1218 of the French Civil Code), in particular strike, natural disaster, armed conflict, pandemic, raw-material shortage, carrier failure, port closure, etc.
12. Customer service and complaints
For any complaint, the Customer may contact Atlantiq Box:
- by email at contact@atlantiqbox.com;
- by phone during opening hours (Monday–Friday, 9 a.m. – 6 p.m. CET);
- via the contact form on the site;
Atlantiq Box undertakes to acknowledge receipt within 1 business day and to provide a substantive response within a maximum of 5 business days.
13. Mediation and dispute resolution
13.1 Consumer mediation
In accordance with article L612-1 of the French Consumer Code, after a prior written approach to Atlantiq Box has remained unsuccessful, the Consumer may use a consumer mediator free of charge. Atlantiq Box is a member of the mediation service René SCHÜNEMANN whose contact details will be provided on request.
13.2 European Online Dispute Resolution platform (ODR)
The European Commission provides an online dispute resolution platform, accessible at ec.europa.eu/consumers/odr.
13.3 Competent courts
Failing amicable resolution, disputes will be brought before the competent courts in accordance with the rules of the Code of Civil Procedure and Regulation (EU) No 1215/2012.
14. Personal data
Personal data collected in connection with the performance of the contract is processed in accordance with the General Data Protection Regulation (GDPR — EU 2016/679) and the French Data Protection Act. For more information, see our privacy policy.
15. Governing law
These T&Cs are governed by French law, subject to the mandatory consumer-law provisions of other Member States of the European Union, the United Kingdom and Switzerland, where they offer the Consumer broader protection.
The contractual language is French. Versions in other languages are provided as courtesy translations; in the event of any discrepancy, the French version prevails.
16. Amendments to the T&Cs
Atlantiq Box reserves the right to amend these T&Cs at any time. The T&Cs applicable to an order are those in force on the date of that order. Existing Customers are informed of any substantive change by prior email.
